TERMS OF SERVICE

These terms apply to purchases made through the NO CONTEXT online store.

The store is operated by Matthew Helliwell, trading as NO CONTEXT, as a sole trader.

  1. PRODUCTS

We take reasonable care to describe and display our products accurately. Colours may vary slightly because of screen settings and normal variations in the printing process.

Product measurements are approximate. Customers should check the available sizing information before ordering.

  1. ORDERS AND CONTRACT FORMATION

Submitting an order is an offer to purchase products from us. An automated order acknowledgement does not necessarily mean that we have accepted the order.

A contract is formed when we confirm acceptance of the order or dispatch it.

We may decline or cancel an order before acceptance if:

• a product is unavailable;
• the price or product information contains an obvious error;
• payment is not authorised; or
• we reasonably suspect fraud or misuse.

If payment has already been taken for an order we cannot accept, it will be refunded.

  1. PRICES AND PAYMENT

Prices are displayed in pounds sterling unless stated otherwise.

Delivery charges and any applicable taxes will be shown at checkout before an order is placed.

Payments are securely processed using the payment methods available through Shopify checkout. We do not directly store complete payment-card information.

  1. PRINT-ON-DEMAND PRODUCTION

NO CONTEXT garments are printed and packed to order by a UK-based fulfilment partner.

NO CONTEXT remains the seller and the customer’s point of contact for all orders, payments, deliveries, returns and complaints.

Because products are printed after ordering, production time is additional to the carrier’s delivery estimate.

  1. DELIVERY

Delivery options, charges and estimated times are explained in our Shipping Policy.

Delivery dates are estimates rather than guarantees unless we have expressly agreed otherwise. We will contact customers if there is a significant delay.

Customers are responsible for providing a complete and accurate delivery address.

  1. CANCELLATIONS, RETURNS AND REFUNDS

Our Return and Refund Policy forms part of these terms and explains cancellation rights, eligible returns, faulty items and refunds.

Nothing in these terms affects a customer’s statutory rights under UK consumer law.

  1. PRODUCT AVAILABILITY

All products are subject to availability. A product may become unavailable after an order is submitted because of garment shortages or circumstances affecting our fulfilment partner.

If we cannot supply an ordered item, we will contact the customer and offer an appropriate alternative or refund.

  1. INTELLECTUAL PROPERTY

The NO CONTEXT name, logos, designs, artwork, wording, photographs and website content are owned by us or used with permission.

They must not be copied, reproduced, sold, distributed or used commercially without our written permission.

  1. WEBSITE USE

You must not:

• use the website for unlawful or fraudulent purposes;
• attempt to gain unauthorised access to the store or another user’s information;
• introduce viruses or other malicious code;
• interfere with the operation or security of the store; or
• use automated systems to scrape or misuse store content.

  1. THIRD-PARTY SERVICES

Our store is hosted by Shopify. Payments, printing, fulfilment and delivery may be provided by carefully selected third parties.

These providers may process information needed to complete an order. Our use of personal information is explained in our Privacy Policy.

  1. LIABILITY

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or a breach of rights that cannot legally be excluded.

Subject to this, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a consumer purchase.

  1. EVENTS OUTSIDE OUR CONTROL

We are not responsible for delays or failures caused by circumstances outside our reasonable control, including postal disruption, severe weather, supply shortages, transport interruption or failures affecting third-party services.

This does not affect rights provided by law where an order is delayed or cannot be fulfilled.

  1. CHANGES TO THESE TERMS

We may update these terms to reflect changes to the store, our services or applicable law.

The terms in force when an order is accepted will apply to that order.

  1. GOVERNING LAW

These terms are governed by the law applicable in Scotland.

Customers retain any mandatory right to bring a claim in the courts of the part of the United Kingdom where they live.
